Acceptable use policy

Scope

This policy applies to all Hostemy services — web hosting, virtual servers, game servers, email sending and domains — and binds both the customer and anyone the customer allows to use them. It forms part of the Terms of service; breaching it is a breach of contract.

Prohibited content and activities

Using the services to host, distribute or link to the following is prohibited:

• Content that is unlawful under Spanish or European Union law, in particular child sexual abuse material, glorification of terrorism or incitement to hatred.
• Material infringing third-party intellectual or industrial property rights, including pirated software and unlicensed protected content.
• Malware, exploits, phishing kits or tools designed to compromise other people's systems.
• Pages impersonating banks, public authorities or any other organisation.
• Fraudulent or pyramid schemes, or the deceptive collection of data or payments.

Network security

No activity that compromises our systems or those of others may be carried out from our services:

• Denial-of-service, amplification or traffic flooding attacks.
• Port scanning, vulnerability analysis or attempts to gain unauthorised access to third-party systems without express, documented authorisation.
• Spoofing IP addresses or email headers.
• Intercepting other people's traffic or data, or any attempt to access other customers' resources.
• Operating anonymisation network exit nodes, open proxies or open mail relays.

Resource usage

On shared hosting plans, resources are shared between customers. Sustained use of CPU, memory, input/output or processes that degrades performance for others is not permitted. Cryptocurrency mining, compute-intensive processing and using hosting as file storage or as backup space unrelated to the website are likewise not permitted. On VPS and game servers the contracted resources apply; abusing network traffic or the host hardware carries the same consequences.

Email sending

The SMTP sending service requires clean sending practices:

• You may only send to recipients who have given verifiable consent. Purchased, rented or harvested lists are prohibited.
• Every commercial message must identify the sender and include a working, one-step unsubscribe method that is honoured immediately.
• Falsifying the sender, subject line or message headers is prohibited.
• Customers must keep their bounce and complaint rates below industry thresholds; exceeding them may lead to rate limiting or suspension of sending in order to protect the network's reputation.
• Sending domains must have SPF, DKIM and DMARC correctly configured.

Game servers

Game servers must comply with the licence conditions of the game in question. Distributing unauthorised binaries or versions is not permitted, nor is using the server as a platform for attacks or for distributing content unrelated to the game.

Consequences of breach

In the event of a breach, and depending on its seriousness, Hostemy may require it to be remedied within a set period, limit the affected resources, remove the infringing content, suspend the service or terminate the contract. Where there is an immediate risk to the network or to third parties, or where content is manifestly unlawful, suspension may be immediate and without prior notice. Suspension for breach does not entitle the customer to a refund, and conduct that may constitute a criminal offence will be reported to the authorities.

Reporting abuse

If you detect use of our network contrary to this policy, write to us at [email protected] stating the IP address or domain involved, a description of the facts and any evidence you have (logs with timestamp and time zone, full email headers or screenshots). We review every report and act accordingly.
